Terms and Conditions
Article 1 – Definitions
In these Terms and Conditions, the following definitions apply:
- Entrepreneur: DYO Studio.
- Consumer: a natural person who is not acting for purposes relating to a trade, business, craft or profession and who enters into a distance agreement with DYO Studio.
- Items: the clothing and accessories offered for sale on the Website.
- Right of withdrawal: the Consumer’s right to withdraw from the distance agreement within the statutory cooling-off period.
- Distance agreement: an agreement concluded between DYO Studio and the Consumer through the Website, using distance communication technology only.
- Webshop: the online shop operated by DYO Studio through the Website.
- Website: dyostudio.nl.

Article 3 – Applicability
These Terms and Conditions apply to every offer made by DYO Studio and to every distance agreement concluded between DYO Studio and the Consumer through the Webshop.
Before the distance agreement is concluded, these Terms and Conditions will be made available to the Consumer electronically in a way that allows the Consumer to store and access them at a later date.
Article 4 – The Offer
DYO Studio aims to describe and display all Items on the Website as accurately and completely as possible.
Obvious mistakes or errors in the offer, including typographical errors, are not binding on DYO Studio if the Consumer could reasonably have understood that such mistake or error was present.
The agreement between DYO Studio and the Consumer is concluded once the order has been confirmed by DYO Studio by email.
Article 5 – Product Information and Condition
Although DYO Studio makes every effort to display the Items as accurately as possible, the Consumer acknowledges that colours may vary slightly from the actual product due to screen settings, lighting and photography.
Where applicable, sizes and dimensions are stated as indicated on the label or as described on the product page.
The Items offered by DYO Studio are described and photographed as clearly and truthfully as reasonably possible. Some Items may be pre-owned or vintage and may therefore show signs of wear. Such characteristics are part of the nature of these Items and will be described where relevant.
In case of doubt about an Item, the Consumer may contact DYO Studio before placing an order via info@dyostudio.nl.
Article 6 – Right of Withdrawal and Returns
For Items purchased online through the Webshop, the Consumer has the right to withdraw from the agreement within 14 days without giving any reason.
The withdrawal period starts on the day after the Consumer, or a third party designated by the Consumer, has received the Item.
To exercise the right of withdrawal, the Consumer must notify DYO Studio within the withdrawal period by email at info@dyostudio.nl.
During the withdrawal period, the Consumer must handle the Item, packaging, labels and tags with care. The Consumer may only inspect the Item to the extent necessary to determine whether they wish to keep it.
If the Consumer exercises the right of withdrawal, the Item must be returned to DYO Studio as soon as possible and in any event within 14 days after notifying DYO Studio of the withdrawal.
Returned Items must be sent back in their original condition, with all supplied accessories, labels, tags, barcodes and packaging, insofar as reasonably possible.
The direct costs of returning the Item are borne by the Consumer.
DYO Studio will refund the amount paid for the returned Item as soon as possible and no later than 14 days after receiving the returned Item or after the Consumer has provided proof of return shipment.
DYO Studio may withhold reimbursement until the returned Item has been received or until the Consumer has provided proof of having sent back the Item, whichever occurs first.
DYO Studio may reduce the refund if the Item has been used, damaged or handled beyond what is necessary to inspect it.
Article 7 – Delivery
The delivery address is the address provided by the Consumer during the ordering process.
Orders are shipped through a logistics service provider selected by DYO Studio.
The prices stated on the Website do not include shipping costs, unless expressly stated otherwise.
DYO Studio aims to ship orders within the delivery timeframe stated on the Website or during checkout. If no specific delivery timeframe is stated, DYO Studio aims to deliver within 14 working days after receipt of payment.
Each shipment may be provided with a Track & Trace code, where available.
If a shipment has not arrived within 14 working days after dispatch, the Consumer should contact DYO Studio via info@dyostudio.nl.
If delivery is delayed, or if an order cannot be fulfilled or can only be partially fulfilled, DYO Studio will inform the Consumer as soon as possible.
DYO Studio reserves the right to make partial deliveries where appropriate.
Article 8 – Prices and Payment
The price of each Item is determined by DYO Studio and may depend on, among other things, the brand, quality, condition, rarity and currency of the Item.
Free shipping applies within the Netherlands, unless stated otherwise during checkout.
After placing an order, the Consumer receives an order confirmation stating the total amount due, including any applicable shipping costs.
Payment can be made using the payment methods offered in the Webshop, including iDEAL and PayPal where available.
DYO Studio will process the order after payment has been received.
Article 9 – Liability
DYO Studio is liable only for damage resulting from an attributable failure to perform its obligations under the agreement, or from an unlawful act, insofar as such liability cannot be excluded or limited by law.
DYO Studio is not liable for indirect damage, consequential damage or loss resulting from the use of electronic payment methods, electronic communication, technical failures, delays or circumstances beyond its reasonable control, except in cases of intent or gross negligence.
Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is not permitted under applicable law.
Article 10 – Force Majeure
DYO Studio is not obliged to fulfil any obligation towards the Consumer if it is prevented from doing so due to force majeure.
Force majeure includes, but is not limited to, war or similar situations, riots, strikes, occupation, blockade, illness of personnel, failure of suppliers or transporters, government measures, transport restrictions, natural disasters, severe weather, lightning, fire and explosion.
DYO Studio may suspend its obligations under the agreement for as long as the force majeure situation continues.
If the force majeure situation continues for more than two months, either party may terminate the agreement without being obliged to pay compensation to the other party.
Article 11 – Items Purchased in the Salon
These Terms and Conditions apply to Items purchased online through the Webshop.
Items purchased in the Salon cannot be returned, as stated on the receipt, unless otherwise required by applicable law.
